1. Agreement to these Terms
These Terms of Use ("Terms") govern your access to and use of atlas360.capital and any page that links to these Terms (the "Site"), operated by Atlas Capital Financial Holdings, LLC ("Atlas," "we," "us"). By using the Site, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Site.
2. Who may use the Site
The Site is intended for business audiences, including home improvement merchants, operators, and remodelers, and their advisors. You must be at least 18 years old to use the Site.
3. Informational purposes only; no offer or advice
The Site describes products and programs that Atlas offers or plans to offer. All content is provided for general informational purposes. Nothing on the Site is: an offer, commitment, or guarantee to provide any product, service, pricing, or terms; an offer or solicitation to extend consumer credit; or legal, financial, tax, investment, or accounting advice. Consult your own advisors before making business decisions.
4. Illustrative content and sample data
Product interfaces, dashboards, transactions, customers, rates, payment amounts, approval amounts, timelines, and similar figures shown on the Site are illustrative examples using sample data. They are provided to demonstrate how products are intended to work. They are not actual offers, quotes, or terms, may not reflect terms currently available, and do not depict any actual person, business, or transaction. Actual pricing and terms depend on eligibility, underwriting, program availability, and the agreements that govern each product.
5. Financing programs
Consumer financing offered through Atlas programs is originated by Atlas's financing provider. All credit is subject to application, verification, and approval by the financing provider, and not all applicants will qualify. Program terms, rates, and availability vary, may change, and may differ by merchant, program, and state. Participation in any Atlas program requires separate written agreements.
6. AtlasPay and pre-launch products
AtlasPay is expected to launch in October 2026. Capabilities described on the Site reflect the product as it is expected to work at launch. Payment services will be provided through Atlas's payment processing partners and sponsoring financial institutions. Features, availability, pricing, and timing are subject to change without notice.
7. Founding merchant program
Founding merchant seats and any founding pricing are limited in availability, are offered by invitation or application at Atlas's discretion, and are subject to eligibility and approval. Atlas may modify, suspend, or discontinue the program at any time. Participation is governed by separate written agreements, and no statement on the Site creates any right to participate.
8. Intellectual property
The Site and its content, including text, graphics, interfaces, designs, and logos, are owned by Atlas or its licensors and are protected by intellectual property laws. ATLAS, ATLASPAY, ATLASFINANCE, and ATLAS360 are trademarks of Atlas Capital Financial Holdings, LLC. We grant you a limited, revocable, non-exclusive license to view the Site for your internal business evaluation. You may not copy, modify, distribute, scrape, frame, or create derivative works from the Site without our prior written consent.
9. Acceptable use
You agree not to: use the Site for any unlawful purpose; interfere with or disrupt the Site or its infrastructure; attempt to gain unauthorized access to any system or data; use automated means to access or collect data from the Site without our written consent; or misrepresent your identity or affiliation.
10. Third-party sites and services
The Site may link to third-party websites and services. Atlas does not control and is not responsible for them, and links do not imply endorsement.
11. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. ATLAS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ATLAS AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, ATLAS'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Atlas and its members, officers, employees, and agents from claims, damages, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
14. Governing law and venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict of laws principles. Any dispute arising from or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Georgia, and you consent to their jurisdiction.
15. Changes to these Terms; miscellaneous
We may update these Terms from time to time. The updated version will be posted with a new effective date, and continued use of the Site constitutes acceptance. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. These Terms and the Privacy Policy are the entire agreement between you and Atlas regarding the Site.
