Privacy Policy

1. Who we are and what this Policy covers

Atlas Capital Financial Holdings, LLC ("Atlas," "we," "us") is a financial technology company organized in Georgia that provides payments and financing products to home improvement merchants. This Privacy Policy describes how we collect, use, and share personal information when you visit atlas360.capital or any page that links to this Policy (the "Site"), and when you communicate with us.

This Policy does not cover the Atlas merchant portal or Atlas program services, which will carry their own privacy notices when they launch. It also does not cover consumer credit applications, which are addressed in Section 9.

2. Information we collect

Information you provide. When you submit our contact form, join the AtlasPay launch list, or otherwise communicate with us, we collect the information you choose to share, which may include your name, company name, email address, phone number, annual revenue range, products of interest, and the contents of your message.

Information collected automatically. When you visit the Site, we and our service providers automatically collect certain information, such as IP address, device and browser type, pages viewed, referring pages, and interactions with the Site, using cookies and similar technologies described in Section 4.

Information from other sources. We may supplement the information above with publicly available business information, such as company details from your website or professional profiles, in order to respond to your inquiry.

3. How we use information

We use personal information to: respond to inquiries and requests; evaluate interest and eligibility for Atlas programs, including the founding merchant program; send updates about Atlas products, including launch announcements, which you can opt out of at any time; operate, secure, and improve the Site; comply with legal obligations; and protect our rights and the rights of others.

4. Cookies and analytics

The Site uses cookies and similar technologies to keep the Site working, understand how visitors use it, and measure the effectiveness of our communications. You can control cookies through your browser settings; disabling some cookies may affect Site functionality.

We do not currently use third-party advertising cookies or share personal information for cross-context behavioral advertising. If that changes, we will update this Policy and honor opt-out preference signals, such as the Global Privacy Control, where required by law.

5. How we share information

We share personal information with:

  • Service providers that host the Site, manage our customer relationships, deliver email, and provide analytics, in each case under instructions to use the information only to provide services to us.
  • Program partners that help Atlas deliver its products, when needed to respond to your inquiry or when you ask us to evaluate your business for an Atlas program.
  • Professional advisors, such as attorneys and accountants, where needed for their services.
  • Authorities and other parties where required by law, to enforce our terms, or to protect the rights, safety, or property of Atlas or others.
  • A successor entity in connection with a merger, acquisition, financing, or sale of assets, in which case this Policy will continue to apply to your information until it is updated.

We do not sell personal information.

6. Your privacy rights and choices

Marketing opt-out. Every marketing email we send includes an unsubscribe link, and you can opt out at any time by emailing info@atlas360.capital.

State privacy rights. Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, and to opt out of certain uses. To exercise these rights, email info@atlas360.capital with your name, state of residence, and request. We will verify your identity before acting on a request and may ask for additional information to do so, and we will respond within the time required by applicable law. Authorized agents may submit requests on your behalf with proof of authorization.

Appeals. If we decline a request, we will explain why, and you may appeal by replying to our response. If your appeal is denied, the law of your state may allow you to contact your state Attorney General.

We will not discriminate against you for exercising your privacy rights.

7. Data retention and security

We retain personal information for as long as needed for the purposes described in this Policy, to comply with legal obligations, and to resolve disputes. We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Children

The Site is intended for business audiences and is not directed to individuals under 18. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.

9. Consumer financing applications

The Site does not accept consumer credit applications and is not directed to consumers seeking financing. Financing applications are submitted through separate application experiences governed by their own terms, disclosures, and privacy notices, including those of the originating financing provider.

10. Third-party sites

The Site may link to third-party websites, such as LinkedIn. Their privacy practices are their own, and this Policy does not apply to them.

11. Changes to this Policy

We may update this Policy from time to time. We will post the updated version on this page with a new effective date and, where required by law, provide additional notice.
